SELLER'S GUARANTEE
Buyer’s Acknowledgment: This agreement is
between Troy/Bethany Miller, Jarbeth’s Kennel (sellers)
and Buyer listed above. This contract is provided upon
request. If this is an internet sale, if we do not
receive notice of a problem with the puppy within the 3
days (below) your signature will be assumed--that you
are in full agreement with the terms below. It is agreed
between Seller and Buyer as follows:
HEALTH GUARANTEE:
SELLER certifies that this puppy/dog is a purebred
(unless purchasing a cross breed) and free of
communicable diseases as far as is identifiable at the
final vet check. SELLER guarantees this puppy/dog to be
free of any communicable diseases for 3 business days
after receipt of puppy. During the 3 days, we require
you to take this puppy to your vet. Any veterinary fees
incurred will be at the buyer’s expense. If your vet
finds a communicable disease we will pay at least 50% of
any treatment necessary, or if the puppy expires during
the 3 day period, we will replace the puppy. (If the
original puppy was shipped to your destination, we will
replace the puppy if you will pay the shipping costs.)
We will require the vet records to be faxed or mailed
to us. Call for our fax number. This puppy/dog has
received shots and wormings (per age) as stated on
attached medical record. If your vet vaccinates your
puppy within two weeks of the last vaccination date on
the shot record, this health contract will be null and
void. This puppy/dog will have been examined by a
veterinarian prior to sale with full disclosure to
BUYER. Any health problems will be stated below:

Seller recommends Royal Canin brand dry
dog foods. Bil-Jac, and Science Diet dog food are also
acceptable. Please do NOT feed your pet a store brand
dog food as health complications will result for which
you, the buyer, will be responsible. Seller does NOT
recommend dog foods made with turkey or pork products.
Chicken, beef, or lamb are acceptable. NOTE:
No health guarantees are offered unless you the customer
place and maintain your pet on NuVet Plus Daily Canine
Supplement. This can be ordered by calling

www.nuvet.com. You must use order number 52700.
This product is that good. Ask your vet, or see
brochure seller will provide.
OWNERSHIP:
Ownership of the puppy/dog listed above will be
transferred to Buyer for the sale price listed above.
(In some cases, the puppy/dog will have limited
registration, if there are certain health issues or at
Seller’s discretion.) BUYER understands that payment is
due one week before puppy is shipped (if shipping is
necessary) or in cash at the time BUYER takes possession
of the puppy/dog if hand delivered. All shipping
expenses must be paid in advance. If a deposit has been
given to hold the puppy/dog and balance due is not
received at the agreed upon time, BUYER forfeits any
deposit given hereunder, unless we, the seller, agree to
extend the time or hold the puppy.
BUYER,
by signing this contract, acknowledges that he/she is
aware that there can be some health problems that are
not uncommon to this breed. Please educate yourself
about this breed before purchase. Some of these
potential health problems are known to be genetic, some
are believed to have some genetic predisposition, and
the cause of others is unknown or is random in
occurrence. BUYER further understands that technology
does not exist to predetermine the genetic outcome of
any breeding in respect to long-term health,
conformation, temperament, or performance ability.
BUYER understands and acknowledges that seller can not
predetermine the outcome of breeding and therefore can
make no assurances that the puppy will be free of
inherited genetic or other disease, nor that the puppy
will meet the buyers expectations in respect to
conformation, performance, or temperament as it ages.
If the puppy expires within one year from date of birth
from a proven genetic defect (vet records required) we
will replace the puppy if you, the BUYER, will pay
shipping charges (if necessary). Any veterinary fees
incurred determining the cause of death will be your,
the buyer’s, responsibility.
BUYERS
RESPONSIBILITIES: BUYER agrees
to take the responsibility for proper care of said
animal and take the puppy/dog to his/her veterinarian
for regular health checks and vaccinations, dewormings,
etc. BUYER assumes responsibility to carry on with
appropriate exercise and feeding schedule. If above
conditions are not met, this contract becomes void.
BUYER agrees that he/she is not acting as an agent in
this purchase; that BUYER will not resell this puppy/dog
to a pet store, or medical research facility. BUYER
also agrees that under NO CIRCUMSTANCES is this
puppy/dog to be placed in an animal shelter or similar
facility. BUYER agrees that if at any time the BUYER
can not take proper care of said animal, the BUYER
should contact the breeder, and the breeder will, 1.
Take the puppy back (no refund provided) or 2. Assist
the buyer in finding a suitable home for the puppy/dog.
***Seller makes no
guarantee in regard to finding a new home for the
puppy/dog, but will make the best effort to assist in
finding a new home.***
This sales contract is
non-transferable. Should BUYER relinquish ownership of
the puppy/dog for any reason, this sales contract shall
be deemed null and void.
In the event of a dispute, the state of Missouri will
have jurisdiction over the matter.
